In those situations, I try to follow suit and match whatever the host does. What a weird thing to take issue with though... As for my physick tears... my guy, I'm invading into - at best - a 2v1. Usually it's 3v1. The host is gonna be close to my rune level, but the phantoms are almost always a couple hundred levels higher. And the host has twice as many flasks as me. So yeah, I'm using physick tears that extend my life. And when I win in that situation, no I don't feel like I won a "fair fight".
